Model portfolio Agreement

The photographer provides clothes for the client based on the client’s measurements, which the client needs to submit at www.nicolazucca.com/modeltest/registration or in a direct message to the photographer at least 7 days before the shooting day. For Polaroid/Digital shoots, the client must bring their own clothes.

The stylings will cover all the intimate parts of the client.

The photographer will select the images for the client based on their expertise to present the client in the most attractive way.

The photographer has 90 days to select, edit, and send the images, including all non-edited images, to the client from the date the full payment is received.

The photographer is allowed to manipulate the images to match their style by adjusting colors, adding or removing noise, and adding or removing details.

The photographer is not allowed to edit the client’s images to make them unrecognizable, dishonorable, or invisible.

The client is allowed to request a re-edit if the edited images are unrecognizable or dishonorable. In this case, the client must specify the changes needed. If the request is unclear, impossible to edit, or outside the photographer’s style, the photographer will revert to the original raw image.

The client is not allowed to request a re-edit based on artistic dissatisfaction, as the client accepted the photographer’s style when choosing them for the portfolio.
Agreement of Payments

In consideration for the photography services provided, the client agrees to pay the photographer the full amount for the images.

The client agrees to pay a non-refundable initial deposit, which reserves the booking date. The deposit is one-third of the total amount.

The client agrees to pay a non-refundable second payment (the second third of the total amount) on the day of the photoshoot, reserving the photographer’s working time.
-
The client agrees to pay a non-refundable third payment (the final third of the total amount) before or after the photoshoot day, which covers photo collection and editing.

The photographer agrees not to offer this time slot to any other potential clients.

If the client cancels the shoot for any reason, the initial deposit will not be refunded.

If the photographer cancels the shoot for any reason, the full initial deposit will be refunded, plus an additional 25% of the deposit as compensation, within 7 days of cancellation.

The client must pay the full amount within 365 days of the shoot date.

The photographer will not send any images to the client until the full payment is received.

Upon receiving the total amount, the photographer has 90 days to send the edited and non-edited images in JPG format.

If the photographer fails to send the images within 90 days due to their fault, the deposit will be refunded, and they will have an additional 30 days to deliver the images.

If the photographer still fails to send the images within the additional 30 days, the full service fee will be refunded, plus an extra 50% of the total amount as compensation.
Copyright, Reproductions, and Usage

The photographer has no right to use the images for advertising or selling without the client’s permission.
-
The photographer is not allowed to leak the photos to the public or third parties and may only send the final images directly to the client.

The client may publish the portfolio to advance their career but cannot sell it or publish it as editorial or fashion material without the photographer’s permission.
-
The client can use both edited and non-edited images but must acknowledge that non-edited images were not selected or approved by the photographer as representative of their work.

If either the client or the photographer publishes the images without the other party’s permission on an unauthorized platform, the other party may request the deletion of the images. Any financial impact of this process must be covered by the party who published the images.

If the client and photographer agree on any point in writing that differs from this agreement, the written agreement takes precedence.

Any matters not addressed in this agreement will be governed by the current European Consumer Protection and Art and Copyright Protection laws.
